PNC Claims Supreme Court Ruling Validates Law Against Parliamentary Party Defection

The governing People’s National Congress (PNC) has hailed a recent Supreme Court ruling as a judicial endorsement of the laws preventing members of parliament from switching political parties.
In a decision delivered on April 29, the apex court upheld a constitutional amendment that mandates the removal of any parliamentary member who changes their political affiliation or is expelled from their party. The court determined that this anti-defection provision does not violate the nation's constitutional framework and confirmed its immediate application to the current 20th Parliament.
The PNC characterized the ruling as a victory for legislative intent, stating that the Sixth Amendment was passed in good faith to protect democratic institutions. The party argued that prohibiting party defection is a standard practice in many democratic nations globally, including those with presidential systems similar to that of the Maldives.
According to the party, the measure ensures legislative stability and strengthens the overall political party framework without infringing upon any constitutionally guaranteed rights. By preventing frequent party-switching, the law aims to reduce political volatility within the Majlis (the Maldivian Parliament).
The PNC noted that this legislative overhaul aligns with the vision of President Dr Mohamed Muizzu. The party stated that the President's strategy focuses on reforming systemic deficiencies and fostering stability in national affairs while simultaneously protecting the fundamental rights and freedoms of Maldivian citizens.
As the ruling takes effect, the governing party maintains that it will continue to operate under democratic principles to secure the most beneficial outcomes for the public. The decision provides the executive branch and the governing coalition with a legal mandate to enforce party discipline within the legislature, marking a significant shift in the Maldives' political landscape.
