Supreme Court overturns High Court ruling on nursery child's grade
National ·
The Supreme Court has set aside a High Court order that directed the Ministry of Education to reassess the grade of a preschool child who had been retained in nursery due to being underage. The case began after the Ministry decided to keep the child in nursery instead of promoting them for the 2024 academic year, citing the child's age. The guardian filed a case in court, and while the Civil Court ruled in favor of the Ministry, the High Court later ordered a new decision based on the child's intelligence and assessments. The state appealed to the Supreme Court, which in a unanimous judgment by the three judges, stated that under the Education Act, a child's entry grade into the national education system is determined by age, and that courts cannot order executive authorities to act against legally vested powers of the Ministry of Education to formulate and implement educational policies.
